Members must be at least 19 years old to enter into a membership contract independently, unless otherwise permitted by applicable law.
Membership privileges may only be exercised by the registered member.
Members must be present throughout reservations made using their membership and must accompany any authorized guests.
Sharing membership credentials, reservation privileges, or electronic facility access with unauthorized individuals is prohibited.

Unused daily simulator time does not accumulate or carry forward.
Memberships do not guarantee a particular simulator bay, reservation time, or uninterrupted availability.
Make Birdie may modify future membership offerings, provided applicable notice and contractual requirements are satisfied.
4. Membership Payments and Automatic Renewal
For recurring memberships, members authorize Make Birdie and its designated payment processor to charge the payment method on file for the agreed membership amount, applicable taxes, and separately authorized charges.
Recurring billing will occur according to the billing schedule disclosed at enrollment.
Memberships will renew according to their stated terms unless properly cancelled.
Members are responsible for maintaining accurate payment information.
Make Birdie will disclose recurring charges, renewal terms, and cancellation procedures before enrollment and obtain any authorization required by applicable law.
5. Failed Payments and Past-Due Accounts
If a membership payment is declined or otherwise unsuccessful, Make Birdie may notify the member and request updated payment information.
Members remain responsible for amounts properly due under their membership agreement.
Access privileges may be temporarily suspended while an account remains past due, following applicable notice requirements.
Make Birdie may terminate a membership for continued nonpayment, subject to applicable law and contractual obligations.
Any returned-payment or administrative fee must be separately disclosed and agreed to before being assessed.
6. Membership Cancellation and Termination
Members may request cancellation by contacting info@makebirdie.com.
Cancellation will be processed according to the membership term and cancellation policy disclosed at enrollment.
Make Birdie may suspend or terminate membership privileges for material violations of this Agreement, including unauthorized access, dangerous conduct, intentional property damage, fraudulent account activity, or continued nonpayment.
Where reasonably appropriate, Make Birdie may provide notice and an opportunity to correct a violation.
Refunds, if any, will be determined by the applicable membership agreement, the reason for termination, and applicable law.
7. Tee Time Reservations
All simulator use requires a valid reservation.
Members must reserve simulator time through Make Birdie's designated booking platform.
Reservations are subject to availability, membership benefits, and booking limits.
Members agree to begin and end sessions within their reserved time.
Late arrivals do not automatically extend a reservation.
Make Birdie may adjust bay assignments or reservations when necessary due to equipment malfunction, maintenance, safety issues, or operational requirements.
When Make Birdie cannot provide a confirmed reservation due to circumstances within its control, it will offer an appropriate remedy consistent with applicable law and the booking agreement.
8. Cancellations and No-Shows
Members should cancel reservations promptly when they are unable to attend.
Repeated failure to cancel unused reservations may interfere with other members' access.
Make Birdie may establish reasonable policies addressing late cancellations, missed reservations, and repeated booking abuse.
Any financial penalties or restrictions must be clearly disclosed before they apply.
9. Guest Policy
Guests are welcome when permitted under the member's membership plan.
Members bringing guests who will play or practice must select "Member with Guest Tee Time" when booking.
Guest fees and complimentary guest allowances are determined by the applicable membership.
Members must remain present while their guests are at the facility.
Members are responsible for informing their guests of facility rules and ensuring that they follow those rules.
Non-playing spectators may attend without a simulator participation fee when permitted by facility policies, provided they do not interfere with safe use of the facility.
Guests may be required to accept a separate liability waiver before participating.
10. Facility Access and Security
Make Birdie operates as a private, unstaffed facility with 24/7 access for authorized members during valid reservations.
Access may be provided through GeoKey or another designated electronic access system.

Minors must remain under the direct supervision of a responsible adult unless Make Birdie has expressly authorized another arrangement.
The supervising adult must ensure that minors comply with facility safety rules.
A parent or legal guardian may be required to execute a separate acknowledgment or waiver for a minor participant.
Any attempted waiver of a minor's legal claims is effective only to the extent permitted by Nebraska law.
15. Assumption of Risk
Indoor golf involves inherent risks, including being struck by golf balls or clubs, slipping or falling, and injuries associated with swinging equipment.
Participants acknowledge these risks and voluntarily assume the inherent risks ordinarily associated with participation.
Participants agree to follow safety instructions and use reasonable care.
16. Release of Liability
In consideration of permission to use Make Birdie's facilities, adult participants agree, to the fullest extent permitted by Nebraska law, to release FORE S.A.M.E. LLC, doing business as Make Birdie, and its owners, employees, agents, and representatives from claims arising from inherent risks of participation and the participant's own acts or omissions.
To the extent legally enforceable, the release is intended to cover claims arising from ordinary negligence in connection with authorized activities.
Nothing in this Agreement waives claims or liabilities that cannot lawfully be waived.
17. Indemnification
To the fullest extent permitted by law, participants agree to indemnify Make Birdie against third-party claims and reasonable expenses resulting from their negligent, reckless, or intentional misconduct or material violation of facility rules.
This obligation does not apply to losses attributable to Make Birdie's own conduct where prohibited by law.
18. Medical Emergencies
Make Birdie is generally unstaffed, and immediate assistance from facility personnel may not be available.
In an emergency, participants should contact 911.
Participants authorize Make Birdie representatives, when reasonably necessary, to request emergency assistance on their behalf.
Participants remain responsible for medical expenses properly attributable to them.
19. Personal Property
Members and guests are responsible for safeguarding their personal belongings.
Make Birdie is not responsible for lost, stolen, or damaged personal property except where liability cannot lawfully be excluded.
20. Maintenance and Temporary Closures
Make Birdie may temporarily close or restrict access to simulator bays or facilities for maintenance, repairs, safety concerns, utility interruptions, or other operational needs.
